Terms of Contract of ATIX AG – Status March 2020

Collection and storage of personal data

ATIX collects and stores personal data exclusively for the following purposes:

  • Customer identification
  • Appropriate customer service
  • Fulfillment of contractual obligations
  • Compliance with legal obligations
  • Correspondence with customers, partners and interested parties
  • Invoicing or dunning process
  • Permitted direct advertising
  • Assertion of any claims

The processing of personal data takes place on the occasion of inquiries with us and is necessary for the purposes mentioned for the processing of orders and for the fulfilment of obligations from the underlying contracts

The personal data collected will be stored until the expiry of the statutory retention period for merchants (6, 8 or 10 years after the end of the calendar year in which the contractual relationship was terminated) and then deleted. This does not apply by way of exception if we are obliged to store the data for a longer period of time due to storage obligations under tax or commercial law (according to HGB, StGB or AO) or if the holders of rights have consented to storage beyond this period.

Transfer of data to third parties

A transfer of personal data to third parties does not take place on principle. Exceptions to this only apply insofar as this is necessary for the processing of contractual relationships. This includes in particular the transfer to service providers commissioned by us (so-called processors) or other third parties whose activities are necessary for the execution of the contract (e.g. shipping companies or banks). The data passed on may be used by the third parties exclusively for the aforementioned purposes.

Your rights as a data subject

As a person affected by the data processing, you are entitled to various rights:

  • Right of revocation: You may revoke any consent you have given to us at any time. Data processing based on the revoked consent may then no longer be continued for the future.
  • Right to information: You can request information about your personal data processed by us. This applies in particular to the purposes of the data processing, the categories of personal data, if applicable the categories of recipients, the storage period, if applicable the origin of your data as well as if applicable the existence of automated decision making including profiling and if applicable meaningful information on their details.
  • Right of correction: You can demand the correction of incorrect or the completion of your personal data stored with us.
  • Right of deletion: You can demand the deletion of your personal data stored with us, as long as their processing is not necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
  • Right to limit processing: You have the right to request limitation of the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful, but you oppose its deletion. You also have this right if we no longer need the data, but you need it to assert, exercise or defend legal claims.   • Right to data transferability: You may request that we transfer your personal data that you have provided to us in a structured, common and machine-readable format.
